 Introduction

Welcome to Harmonic Pathways! These Terms and Conditions ("Agreement") govern your use of our website, products and services, including access to and purchase of online music courses. By accessing or using our platform, you agree to comply with these terms. If you do not agree, please refrain from using our services.​

Harmonic Pathways is a sole proprietorship operated by Cosmin Codreanu, registered in Austria.

1. Scope of Services

Harmonic Pathways provides access to online music courses, including pre-recorded lessons, live sessions, and supplemental materials. Access is granted only to registered users who have purchased a course or subscribed to a membership plan. The availability of certain features may vary depending on the course purchased.

We reserve the right to modify or discontinue services only with 30 days' prior notice via email or platform notification. Substantial changes (e.g., price increases >10%, core feature removal)  will allow users to terminate their account and receive a pro-rata refund for unused subscription periods.

"Pro-rata refunds" apply only to subscription plans, not one-time purchases.

2. User Accounts

To access our courses, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials.

Account sharing or unauthorized use is prohibited. Harmonic Pathways may suspend accounts only with documented evidence of violations and will provide a 14-day remediation period before termination. Account data will be anonymized 90 days after termination, except where legal obligations require retention.​

 

3. Payment Terms

All course fees must be paid in full at the time of purchase unless stated otherwise (e.g., installment plans). Prices include applicable Austrian VAT (20%) unless specified.

Failure to complete payments allows restricted access only after two formal payment reminders sent via email. Service termination for non-payment requires 30 days' notice.

4. Refund Policy for digital purchases

In accordance with EU Consumer Rights Directive (2011/83/EU) and Austrian Consumer Protection Act (KSchG):

• You have a 14-day right of withdrawal from purchase date. Your right of withdrawal remains valid for non-streamed/non-downloaded content. Partial refunds apply if you consent to early access of restricted materials.

• Refund requests must be submitted to support@harmonicpathways.com.

• Pro-rata deductions apply only if you explicitly consent to early content access during the withdrawal period.

• Subscription plans may be canceled before each renewal cycle with 14 days' notice.

• Refunds will be processed within 14 days of request validation.

5. Third-Party Fulfillment and Shipping

Dropshipping Fulfillment Disclosure: "Harmonic Pathways" operates using a dropshipping business model, wherein we partner with third-party suppliers who directly fulfill and ship orders to customers. While we carefully select our suppliers and maintain quality standards, you acknowledge that the physical products purchased through our website are manufactured, stored, and shipped by these third-party suppliers and not directly by "Harmonic Pathways".

 

Liability Distribution: "Harmonic Pathways" remains your primary contractual partner for all purchases made through our website. We maintain responsibility for processing your order, providing customer service, and ensuring compliance with all applicable consumer protection laws. However, we disclaim liability for manufacturing defects, shipping delays caused by the supplier, customs issues outside our control, or other logistical matters directly attributable to our third-party suppliers. Notwithstanding this limitation, we will make reasonable efforts to resolve any issues that may arise with our suppliers on your behalf.

Order Fulfillment and Delivery: Upon placement of an order, your purchase and shipping information will be forwarded to our relevant supplier for fulfillment. You consent to the sharing of necessary personal information with our suppliers for the sole purpose of order fulfillment. Estimated delivery times are provided as guidance only and cannot be guaranteed due to the involvement of third parties in the shipping process.

Customs and Import Duties: For orders shipped from suppliers outside the EU, additional customs fees, import duties, and taxes may apply upon entry into the EU. These charges are not included in our prices and are the responsibility of the customer. As of July 1, 2021, VAT is collected on all imported goods into the EU regardless of value. "Harmonic Pathways" will endeavor to provide transparent information on potential additional charges prior to purchase completion.

Warranty and Returns

Legal Warranty Rights: As your contractual partner, "Harmonic Pathways" fully honors your statutory warranty rights under Austrian and EU consumer protection law. Despite our use of third-party suppliers, you maintain the right to return products within 14 days of receipt for a full refund without providing a reason (statutory cooling-off period).

Product Defects: In the event of product defects or non-conformity, "Harmonic Pathways" accepts full responsibility for resolving the issue in accordance with Austrian and EU consumer law, regardless of whether the defect originated with our third-party supplier. We may offer repair, replacement, or refund depending on the circumstances and in compliance with legal requirements.

Return Logistics: When returning products, you may be required to ship the item to an address different from our business address, including potentially directly to our supplier. All return shipping information will be provided upon initiation of the return process. Return shipping costs may be your responsibility unless the return is due to a defective product or an error on our part.

 

6. Licensing and Intellectual Property

All content is protected under Austrian Copyright Act (UrhG) and EU Directive 2019/790. Purchases grant a non-exclusive, revocable license for personal use.

Unauthorized distribution triggers a three-strike process: (1) warning, (2) temporary suspension, (3) termination with preserved refund rights for unused periods. This policy supplements but does not replace statutory copyright enforcement procedures under Austrian law.

7. Disclaimers

a. Content Accuracy

We strive for accuracy but cannot guarantee error-free material. Substantive errors may be corrected within 30 days of notification without altering core course content.

b. Service Availability

Scheduled maintenance will be announced 72 hours in advance. Unscheduled downtime exceeding 24 hours entitles users to service period extensions.

c. Learning Outcomes

Skill development depends on individual practice.

8. Modifications and Interruptions

Harmonic Pathways reserves the right to update course content periodically to ensure quality and relevance. We may also temporarily suspend services for maintenance or updates with 30 days prior  notice via email. For extended unplanned outages (beyond 24 hours), users will be entitled to service extensions or partial refunds, as required by the Austrian Consumer Protection Act and EU Digital Content Directive (2019/770).​

Users must submit outage claims within 7 days via support@harmonicpathways.com.

 

9. Third-Party Content

Some courses may include contributions from guest instructors or links to third-party resources. Harmonic Pathways does not endorse or assume responsibility for the accuracy or reliability of third-party content.

10. User Responsibilities

By using our platform:

- You confirm that you meet any technical requirements. 

Minimum technical requirements:

• Internet: 5 Mbps download speed (test via Speedtest.net)

• Browser: Chrome v102+ or Firefox v110+

• RAM: 4GB minimum

- You are responsible for obtaining any additional materials (e.g., instruments) required for participation in the course.

- You agree not to engage in disruptive behavior during live sessions or misuse discussion forums.

11. Limitation of Liability

Under Austrian Civil Code (ABGB) §1295 and Product Liability Act (PHG):

• Liability for slight negligence limited to annual subscription fees

• No exclusion for gross negligence, willful misconduct, or personal injury

• Statutory warranty rights preserved under Austrian Commercial Code (UGB) §377

12. Governing Law

Disputes governed by:

• Austrian Consumer Protection Act (KSchG)

• EU Directive on Digital Content (2019/770)

• Jurisdiction: Competent court in Vienna or EU consumer’s local jurisdiction under Brussels I Regulation

• The consumer has the right to use the EU ODR platform (https://ec.europa.eu/consumers/odr) for resolving disputes, as required by EU Regulation 524/2013

13. Termination

Harmonic Pathways reserves the right to suspend or terminate your account if you violate these terms or engage in unauthorized activities on our platform. Termination due to violations revokes access without refund. Termination for non-violation reasons entitles users to pro-rata refunds per §4

in accordance with Austrian Consumer Protection Act requirements.

14. Changes to Terms

We may update these Terms & Conditions at any time with 30 days via email prior notice. Continued use of our platform constitutes acceptance of the updated terms.

15. Accessibility Clause

We strive to ensure accessibility for users with disabilities, as mandated by the Austrian Disability Equality Act (BGStG) §6. Contact support@harmonicpathways.com for alternative formats or accommodations.

16.Consumer Rights Summary

As a consumer, you have legal rights under the EU Consumer Rights Directive, including a 14-day withdrawal period. These rights are not affected by this Agreement.
